The Ninth Circuit U.S. Court of Appeals upheld the suspension of President Donald Trump's immigration order that banned visitors and immigration from seven majority-Muslim nations, delivering a blow to Trump.

TheStreet's Emily Stewart discussed the likely next step, which will either involve the Trump administration taking it to the Supreme Court or withdrawing the order and resubmitting it after recasting it. Stewart said the latter is unlikely "given Trump's personality." If the case goes to the Supreme Court, the decision of the lower court would stand if there was a four-to-four split on the higher court. Regardless, Stewart said the topic of immigration is not going anywhere.

"It's definitely not over," Stewart said.
