False Advertising Lawsuit Against SeaWorld Moves Forward

California district Judge Jeffrey White ruled that a group of consumers can pursue their claims against SeaWorld (SEAS) - Get Report . They argued they were lied to about the condition of the water park's orca whales in marketing materials and ads.

One argument was that the consumers were told by park trainers that the orca whales' collapsed fins were normal. They actually aren't and are a sign of distress, as is shown in anti-SeaWorld documentary Blackfish.

SeaWorld tried to have the claims, which were filed as a third amendment complaint in November, dismissed. The judge ruled that the claims were properly filed under California's Consumers Legal Remedies Act and Unfair Competition Law.

The case was first filed in May of 2015 but some claims were dismissed previously.
