Network Appliance (NTAP) - Get Report agreed to acquire closely held data replication software maker Topio for $160 million in cash.

Sunnyvale, Calif. based NTAP said Topio is based in Santa Clara, Calif., with research and development in Haifa, Israel.

The acquisition is expected to close in December 2006, subject to customary closing conditions. Topio will be a new business unit within NetApp, and its research and development team will continue to operate in Haifa. Topio is committed to maintaining and furthering its deep relationships with global enterprise customers.

Network Appliance rose 5 cents early Wednesday to $36.76.
