(eBay suit article updated with commentary from the company.)NEW YORK ( TheStreet) -- eBay ( EBAY) is being sued for more than $3.8 billion by a firm that claims it stole its idea for PayPal. XPRT Ventures filed a suit on Tuesday in the U.S. District Court in Delaware, claiming eBay infringed on six patents to develop online payment systems. According to XPRT, the online retailer and auctioneer used ideas and methods that XPRT developers shared with eBay in confidence. "eBay incorporated such inventive concepts and ideas into its auction payment process during current California gubernatorial candidate Meg Whitman's tenure as eBay's CEO," XPRT wrote in a statement. "eBay's unauthorized incorporation was a misuse of Inventors' confidential and proprietary material." eBay said it is reviewing the complaint "We believe it is without merit, and intend to defend ourselves vigorously." -- Reported by Jeanine Poggi in New York.
