Question: My spouse passed away and Social Security said I was not eligible for his benefit because of pension and retirement. He paid into Social Security for years, but they said I drew a little too much than him. What is your response on this situation? He earned that fair and square and taken it away from me. Could you steer me in the right way to get what he worked for?

Answer: It seems as if you had a higher earning history than your late husband, said Joseph Stenken, an advanced markets product consultant with Ameritas.

"Social Security pays out the larger of a survivor benefit or a retirement benefit," said Stenken. "So, if your retirement benefit was larger than his benefit was you would get no additional benefit." Read more.

Question: I'm a retired federal employee under the Civil Service Retirement System or CSRS. I'm eligible for a reduced Social Security payment. My wife is currently working and is under the Federal Employees Retirement System or FERS. Can I collect my Social Security based on my wife's Social Security since hers is much larger than mine? I assume it will still be reduced by the windfall elimination provision or WEP.

Answer: Benefits from your wife's work history will be reduced by 2/3rds of your government pension under the government pension offset (GPO) provisions, said Stenken. The Windfall Elimination Provision applies to a person's own benefit and reduced the benefit if that person worked for less than 30 years in a job covered by Social Security. Read more.
