The Wall Street Journal reports Trump Campaign Launches New Tactic in Legal Fight to Contest Election Results

The Trump campaign and its allies unveiled a new tactic to contest election vote counts, suing to stop state officials from finalizing results due to fraud allegations in Michigan and limits imposed on poll observers in Pennsylvania.

Judges likely would be reluctant to take the rare step of blocking final vote counts without seeing substantial evidence of fraud or irregularities widespread enough to change the election, legal analysts said. 

President-elect Joe Biden was declared the winner by the Associated Press in Michigan and Pennsylvania by margins that election-law experts say would be difficult to overcome in court. In Michigan, Mr. Biden’s lead was 146,000 votes with 99% counted, and in Pennsylvania it was over 45,000 votes with 99% counted.

Alleged fraud that affects fewer votes than the difference between the two candidates is a nonstarter, said Barry Richard, the lead counsel to former President Bush in 2000.

“The law on fraud is very simple,” he said. “You walk into court and have to bring in evidence that there was fraud or voting irregularities, and you must show that it could change the election.”

Separately, a group of 10 Republican state attorneys general filed an amicus brief on Monday supporting Pennsylvania Republicans in asking the U.S. Supreme Court to reverse the state’s three-day extension for receiving mail-in ballots.

Trump is behind by 45,000 votes even if late ballots are discarded.

This is one act of desperation after another after another, with no credible evidence remotely close to what is required.

We all knew in advance and I even reported on it here that the early voting and mail-in voting was overwhelmingly Democratic.

In many states that was tabulated last.

The surge was expected IN ADVANCE.

Seeing a lot of this wishful thinking from Trump supporters. They're still poring over electoral numbers over on ZH like it's election night, looking for scenarios to reach 270. Not sure why they're torturing themselves like this, but the drama could extend all the way to 12/14.

Future historians will struggle mightily to understand how someone like Trump could inspire this level of fanatical loyalty among followers. I guess that was the purpose of QAnon, to transform Trump from a political figure to a religious one.

I couldn't place my finger exactly on what was going on with Trump supporters as the days go on since it became clear Trump was not the winner but could tell their belief is escalating, you have in essence the beginnings of what I call a "rachet" effect for his supporters and himself and anyone inside the Trump orbit(people like McConnell, GOP, etc). The belief whether true or false is now self perpetuating and feeding upon itself. I have observed this effect in revolutions in other countries such as the one in Egypt a few years ago.

The hallmark of a rachet effect is to self perpetuate/self fuel themselves and they are notoriously hard to stop, because by definition you can only tighten/heighten the effect, in this case the belief that widespread election fraud happened, you see now others like Barr and McConnell being pulled in, in fact the military may at some point be pulled in as an arbiter to the situation if a suitable off ramp is not found. This is situation is headed towards unstable ground as it's going to run into outside reality at some point(courts unwilling to rule in favor, elected officials from other party not heeding the line, etc.).

While I personally don't support Biden or Trump, the GOP that while this does bring them donations/outrage/etc. Once the rachet effect gets going strongly they may not be able to contain/control the individuals on the ground, they are in essence playing with fire here. No matter what you believe as an individual it's important to take a breather here and consider whether you yourself are currently part of this rachet effect on the Trump side, nothing good will come from this.

With such a love for the Democrat Party I wonder why you left Illinois. When I asked if Chicago's elections are fair you said yes they are fair even though Chicago is recognised as being one of the most corrupt cities in America. You are very good at economic analysis but it looks to me that when it comes to politics you have a blind spot if you can't "see' corruption. The suits will fail legally but succeed in not allowing Biden to be ready to lead when his term begins and ensure the nation doesn't come together. Seems a guarantee Senate investigates missing strawberries and calls Joe Biden in as star witness as first order of business.

Emily Murphy, a Trump loyalist heads the GSA and is refusing to certify the election for Biden. Without this certification, the Biden team cannot begin their transition. She has no legitimate reason to withhold certification.

A writ of mandamus needs to be filed immediately to force her to do her job.

Mish, I also find this belief in conspiracy theories to be scary, sad and yes, dangerous. The large numbers of people who can be so easily convinced of these ridiculous theories demonstrates the powerful effect of cults, political parties and even religious groups.

We are going to have to expand the number of popular conspiracy theories that the feeble minded are duped into believing:

The world is flat

We never landed on the moon

The world is only 6000 year’s old

Vaccines cause autism; or vaccines are a conspiracy to track or control you

Global warming is a hoax

The Pandemic is a hoax, no worse than the flu

The 2020 US Election was a fraud

I find it interesting that many people who are duped into believing one conspiracy theory, often believe several of them.

Of course, it doesn’t help, when the most powerful person in the world, the US President, believes and promotes so many of these conspiracy theories.

It’s funny that an anti-vaxxer like Trump is now promoting a vaccine, as if he created it himself.

As Trump’s niece Mary says:

”This is what Donald’s going to do: he’s not going to concede, although who cares. What’s worse is he’s not going to engage in the normal activities that guarantee a peaceful transition. All he’s got now is breaking stuff, and he’s going to do that with a vengeance.”

If Donald can’t run the US, he will attempt to break the US. And he might succeed if enough of his cult members follow his lead.

I don’t think these court cases are going anywhere. The system could use some improvement, but the results of this election will stand....

Partisan bickering is inevitable in the current milieu....unfortunately. Given the present circumstances, it doesn’t make much sense to drag this out. No matter how much fraud is proven, it will never amount to 1% of what has actually occurred.

Mish, Honestly? There is, for statisticians, very little doubt that the election in some states may be fraudulent based on every... repeat... every tool routinely used to analyze these kind of data flows.

I strongly recommend you step aside and let this important process work through the courts. In this case, Trump is not the focus, its the American voter's right to a free, fair and honest election. 70 million people are very concerned. At a minimum its the the lack of oversight in every sense of the word....at best, premeditated and deliberate intervention at worst. I'll go out on a limb and simply say that this process will be an unusually fast one and we'll worth you waiting.

There will be a few cases of fraud every election but if you were to look across all votes, there are errors not favoring one candidate or the other. Trump is no different but he thinks he is. When you have 146M votes, there will be errors but that doesn't mean it was fraudulent. Trump will take the tiniest amount of error and call it fraud. This has been the MO of Trump since he stepped down the elevator at Trump tower and called Mexicans rapists and drug dealers.

After World War 1, many Germans refused to accept defeat. They weren't actually defeated, they rationalize, they were stabbed in the back. They blamed Jews for the defeat, among other scapegoats. They used conspiracy theories to deflect reality.

This persisted all the through the Weimar Republic and was one of the sentiments that Hitler leveraged for political power.

The US is not a fascist state as long as the elections hold. But I am starting to worry that there is a growing fascist, anti-democracy movement here in the US. They are attacking the legitimacy of the elections because they didn't get the result they wanted.
