ACTV claims the Enhanced TV systems offered in connection with the broadcasts of
Monday Night Football
Who Wants To Be A Millionaire
on ABC, along with
Sunday Night Football
on ESPN, infringes on three of the company's patents. ACTV is seeking an injunction and unspecified monetary damages.
"We view the Disney litigation as a step we must take to protect our patents and support our licensing program," ACTV, a New York-based interactive television technology maker, said in a statement.
Representatives for Disney weren't immediately available for comment.
Shares of ACTV fell 13 cents, or 2.6%, to $4.75 in recent
trading. Disney dropped $1.50, or 5.2%, to $27.63 on the Big Board.
