LML Settles Litigation With HSBC
VANCOUVER, British Columbia, March 3, 2011 (GLOBE NEWSWIRE) -- LML Patent Corp. ("LML"), a wholly-owned, indirect subsidiary of LML Payment Systems Inc. (the "Corporation") (Nasdaq:LMLP), announced today that it has entered into a Settlement and License Agreement (the "HSBC Agreement") with HSBC Holdings PLC with respect to litigation filed by LML in the U.S. District Court for the Eastern District of Texas alleging that HSBC infringed U.S. Patent No. RE40,220 (the "Patent Litigation").
The HSBC Agreement provides HSBC with a fully paid-up license to certain LML patents for electronic check conversion transactions including "ARC", "WEB", "POP", "TEL" and "BOC" and primarily has as its basis, HSBC's transaction volume. HSBC agreed to pay $5,500,000 in respect of the Agreement.
In addition, at a pretrial conference held March 1, 2011, commencement of the Phase I trial in the Patent Litigation (as disclosed in the Corporation's Form 10-Q for December 31, 2010) was moved from March 8, 2011 to March 21, 2011 to accommodate the Court's schedule."We are extremely pleased to have settled our litigation with HSBC, and we welcome them as valued licensees," said Patrick H.
