Meanwhile, State Street (STT) were up 0.3% to $44.06 on an upgrade. Argus analysts upped their rating on State Street to buy from hold with a price target of $60, arguing that expectations for earnings growth in 2010 are low.

Most bank stocks were mixed in afternoon trading. Bank of America (BAC) gained 0.5% to $15.06. Wells Fargo (WFC) rose 2% to $28.20. JPMorgan Chase (JPM) tacked on 0.6% to $39.44. Morgan Stanley (MS) shares rose 1% to $28.02.

On the other hand, Goldman Sachs (GS) fell 0.7% to $153.95. Citigroup (C) fell 0.5% to $3.21.

Zions Bancorp (ZION) was among smaller bank stocks trading higher Tuesday. Zions late Monday posted a fourth-quarter loss of $1.26 a share, better than the Thomson Reuters average estimate for a loss of $1.64 a share. Zions said its provisions for loan loss was $390.7 million, down from $565.9 million in third quarter.

Chairman and CEO Harris Simmons said the bank is "confident that peak levels of loan losses are behind us." Zions shares were rallying 8.3% to $19.40.
