DETROIT (AP) — Former Detroit mayor Kwame Kilpatrick was three days late and $3,500 short on a May restitution payment ordered as part of the criminal case that drove him from office, according to the Michigan Department of Corrections.

The payment due on the 15th of each month came on May 18 and was only for $2,500 of the $6,000 required, department spokesman Russ Marlan told the Detroit Free Press.

A judge in March rejected Kilpatrick's request to reduce payments for his nearly $1 million in restitution to $6 a month. Kilpatrick was ordered to pay $6,000 a month. If he fails to make full payments, Kilpatrick could be found in violation of his probation.

Michael Alan Schwartz, Kilpatrick's lawyer, did not immediately respond to a message seeking comment early Wednesday.

Kilpatrick resigned as mayor Sept. 18 and served 99 days in jail for obstruction of justice and assault. He took a sales job in Texas with Covisint, an affiliate of Detroit-based software maker Compuware Corp., and now lives in the Dallas area.
