Biotech/Pharmaceuticals
In April 2003, MedImmune (MEDI), one of the biotech companies that pays royalties to use the Cabilly patent, filed a lawsuit that included Genentech and Celltech and claimed violations of antitrust, patent and unfair competition laws. The MedImmune litigation hasn't yet been resolved.
Among other things, MedImmune wants to have the patent declared invalid along with a finding that it doesn't owe royalties on sales of its Synagis product. Shares of Genentech were up $3.49, or 4.4%, to $83.35. MedImmune, of Gaithersburg, Md., rose $1.65, or 5.2%, to $33.23.TheStreet Premium Services
